These Terms and Conditions explain how I work with clients and the terms that apply to my freelance WordPress services and this website.
Last Updated: October 7, 2026
1. About These Terms
These Terms and Conditions apply to the WordPress development, consulting, maintenance and related services provided by Nitin Arya (“I”, “me”), an independent freelance WordPress developer based in India, and to the use of this website. By engaging my services or using this website, you agree to these terms.
2. Services
The services, deliverables, timelines and fees for each project are agreed in writing before work begins, for example in a proposal, quote, email or project brief. Work outside the agreed scope may be quoted separately.
3. Quotes and Estimates
Quotes are based on the information available at the time. If the requirements change, or if the existing website or systems differ from what was described, the scope, timeline and cost may need to be updated before work continues.
4. Payments
Payment terms are agreed for each project. Larger projects may require an advance payment before work starts, with the balance due at agreed milestones or on completion. Hourly work is invoiced based on the time spent.
I accept payments through methods including UPI, PayPal and bank transfer. Any payment provider or transfer fees are the responsibility of the paying party unless agreed otherwise.
Work may be paused if invoices remain unpaid after the agreed due date.
5. Client Responsibilities
To deliver the work, you agree to:
- Provide accurate requirements, content and feedback in a timely manner
- Provide the access needed (WordPress, hosting, domain or third-party accounts) through secure methods
- Ensure you have the rights to any content, images, fonts or materials you supply
- Keep your own backups of your website and data where possible
- Review and approve work within a reasonable time
6. Timelines
Timelines are estimates based on the agreed scope. Delays in receiving content, feedback, access or payments, or changes to the scope, may affect the delivery date.
7. Revisions
The number of revisions included depends on the project and is agreed as part of the scope. Additional revisions or changes requested after approval may be charged separately.
8. Ownership and Licences
Once full payment has been received, you own the final custom work created specifically for your project. Third-party themes, plugins, fonts, libraries and services remain subject to their own licences and terms.
I may reuse general techniques, know-how and non-client-specific code. I may also mention the project in my portfolio unless you ask me not to.
9. Third-Party Services
Projects often rely on third-party software and services such as hosting, plugins, themes, payment gateways and APIs. I am not responsible for their availability, changes, pricing, security or performance, although I will help where I reasonably can.
10. Confidentiality
I treat your business information, access credentials and project details as confidential and use them only as needed to provide the services. Access credentials should be changed or removed once my access is no longer required.
11. Warranties and Liability
I provide services with reasonable skill and care. However, no website can be guaranteed to be completely free of errors, downtime or security issues, and I cannot guarantee specific search rankings, traffic, speed scores or business results.
To the extent permitted by law, my total liability for any claim related to a project is limited to the amount paid for that project. I am not liable for indirect or consequential losses, including lost profits, data or business opportunities.
12. Cancellation
Either party may end a project by giving written notice. Work completed up to that point is payable. Refunds are handled as described in the Cancellation & Refund Policy.
13. Website Use
The content on this website is provided for general information. You may not copy or reuse it for commercial purposes without permission. Your use of personal data on this website is covered by the Privacy Policy.
14. Governing Law
These terms are governed by the laws of India. Any disputes will first be discussed in good faith to find a fair solution.
15. Changes to These Terms
I may update these terms from time to time. The latest version will always be published on this page with a revised “Last Updated” date.
